Mysterious Mass Deaths Continue

Numerous locals woke to discover hundreds dead birds, convinced it was just some more of the rash of mysterious mass deaths that have taken place around the globe in the early part of 2011.

The United States government quickly took responsibility for killing hundreds of birds in Yankton, South Dakota.

Posing a danger to the animals and farm workers, five thousand birds were defecating in the feed meal of a feedlot. USDA decided to poison the birds with bait, laced with poison DCR-1339.

Officials had not expected the birds to fly nearly 10 kilometres, before succumbing to the poison.

Normal reports of mass deaths average around 3.4 per week. The beginning of 2011 has seen this number greatly exceeded globally. Authorities say the deaths are not connected, but have both local authorities and scientists baffled.

Greg Butcher, director of bird conservation at the Audubon Society, said "Mass bird die-offs can be caused by starvation, storms, disease, pesticide, collision with man-made structures or human disturbance ... Initial findings indicate that these are isolated incidents that were probably caused by disturbance and disorientation."

Registered Preparer Continuing Education Requirements

The IRS is making sweeping changes in the tax preparation industry in order to ensure that only qualified individuals serve the public. Preparers will now have to obtain a Preparer Tax Identification Number (PTIN), accrue a certain amount of continuing professional education (CPE) and pay the annual .25 fee.

Registration Guidelines

Every individual that would like process tax returns after December 30, 2010, will need to obtain a PTIN. The requirement is all encompassing, so it applies to employees of tax preparing businesses as well. For those that already have a PTIN, registration into the new IRS system is still required in order renew the number. Registration capabilities are expected to begin in the middle of September 2010.

Competency Testing

Competency testing must be completed (and successfully passed) in order to receive a PTIN.

It provides an individual the ability to complete Form 1040 series returns. Two different tests will need to be taken within 3 years, which will cover:

Wage & Non Business 1040

Wage and Small Business 1040 (Schedules C, E, F and related forms)

The exams are scheduled to be available in the middle of 2011. In the future, the IRS plans to have additional testing and instructions for other forms.

At this time, the IRS has not yet determined the mandatory passing score for the competency testing. Other details, such as the components of the exam, testing procedures, locations and the applicable fee have not yet been established either. However, a registrant will have the ability to take the test an unlimited number of times.

Any person that does not complete this requirement within the designated period will have their PTIN deactivated and will be taken off the list of registered preparers.

Continuing Professional Education CPE

Each PTIN holder will need to complete 15 hours of tax CPE in order to maintain his or her registration in the IRS public database.

It is important to note that tax preparers should wait until January 1, 2011 to begin accruing their CPE credits, as any tax courses taken before this date will be ineligible to meet the IRS requirement. The curriculum must consist of 10 hours of Federal Tax Law, 3 hours of Tax Changes/Updates and 2 hours of Ethics CPE.


An exception to the mandatory testing exists for attorneys, enrolled agents and CPAs (enrolled actuaries and enrolled retirement plan agents are included only if their tax preparations are within their limited practice area). It is important to note that if one of these types of practitioners is not active and in good standing, then they will be subject to competency testing.

To qualify for an exemption to the CPE requirement, a tax return preparer must be an attorney, CPA, enrolled actuary or enrolled retirement plan agent. Registered or licensed public accountants in certain states are deemed to hold the same rights as a CPA and do not have to take the exam or meet the CPE requirements.

ACL Surgeon: Well, the original graft for ACL surgery actually was tendinous tissue. The tensor fascia lata band was used. Very soft tissue grafts were used. And the problem with that was that they were non-anatomical and there were issues with fixation.

Then the bone-patellar tendon- bone graft really developed and gained as the foremost graft in the 80s, as fixation for this was quite good, the strength of this was quite good, and really there were good techniques involved in using the arthroscope.

Hamstrings were then developed around the same time and utilized in the late 80s, early 90s, into the 90s, and gained favor as this was an alternative graft. The problem however, and some of the early research and literature was that the fixation for the hamstring or soft tissue grafts wasnt quite as good as the patellar tendon. Therefore the clinical results seemed to be behind that of the patellar tendon graft. So then it lost a bit of favor in the 90s maybe into the 2000s.

Then with the development of other fixation devices, it has made a surge back into favor and certainly is a nice alternative graft source and a nice graft for reconstruction of the ACL. It now is thought of, in terms of fixation, as similar to that of patellar tendon and really thought equally in terms of utilization as a graft in many instances. In fact, many people will consider it a better graft source for certain people.

If the name of the prospect is obtained from a lead source, the source must be disclosed to those over age 65.

Even though it is in nearly all agent's contracts, it does not hurt to point out that the insurance company must give an agent permission in writing before the agent can advertise the product.

Insurance Continuing Education - Cancelling a Flood Insurance Policy

The cancellation or nullification of Flood Insurance Policy procedures can be found in detail at http://www.fema.gov/business/nfp/manual.shtm  -  and it contains some10 pages of detail.  This discussion does not cover all of the intricacies and details contained in the manual, but should give the agent guidance on what canceling or nullifying a policy can entail, what is needed, and how it can be explained to the client.


Refunds will be made by the insurance company for the current and one prior year.  If refund is requested for a period of more than 2 years, then the NFIP must process the request.  The request must consist of a policy cancellation request and the premium refund calculation for each year.  (A copy of the cancellation request form follows.)  The insurer must also include statistical records for each policy term and evidence of premium having been received—accounting details which should be expected.


Current Policy Number: In the upper right-hand corner of the form, enter the NFIP policy number.

Policy Term: Enter the policy term and the cancellation effective date.

Agent Information: Enter the complete name, mailing address, phone number and fax number of the agent/producer.

Insured Mail Address: Enter complete name, mailing address and phone number of the insured.  If insured has moved, enter the new mailing address.

First Mortgage: Enter the complete name, mailing address, phone number and fax number of the first mortgagee.

Other Parties Notified: Enter the complete name, mailing address of all other interested parties that should be notified, such as an additional insured, second mortgagee, loss payee, trustee, or disaster assistance agency.

Property Location: Enter the location of the insured property.

Cancellation Reason Code: Check the reason for cancellation of the policy and provide any additional information required.  (A list of cancellation codes follows.)

Refund: Check the appropriate box to indicate to whom the refund is to be made payable.

When the cancellation/nullification notice has been received and if it directs the NFIP to make a premium refund to the PAYOR, and the policy has been endorsed showing the PAYOR as a WYO company or agency, then

F the NFIP will make the refund payable to the insured and mail the refund in care of the producer.

Check the appropriate box to indicate to whom the refund should be mailed.

Signature: The insured must sign and date the Cancellation/Nullification Request Form for all cancellation reason codes except for 5 and 6.  The producer must sign, date, and enter a Tax ID Number or Social Security number in every case.  After the form is completed, attach all supporting documents, and mail the original to the NFIP

The producer should retain the second copy; the third copy goes to the insured and the 4th copy to the mortgagee.

After this form has been processed, the NFIP will send the producer, mortgagee and insured a notice of cancellation.



The following reason codes for cancellation/nullification of NFIP policies is a summary of the reasons as most of them are self explanatory.  For more details, please refer to the Flood Insurance Manual.

1.  Building Sold or Removed.  Insured has no more insurable interest, or any other reason that the building is sold or removed.  If the building is sold, proof of sale is required.  Request must be received within 1 year of sale/removal, accompanied by Bill of Sale, settlement statement, or other such proof of removal or total loss.  Up to 2 years pro rata refund

2.  Contents Sold or Removed.  Insured no longer has an insurable interest or the property has been removed from the property.  Proof is needed, such as Bill of Sale, etc.  Pro rata refund.  Cancellation request must be received within 1 year of new policy effective date.


Policy Canceled and Rewritten to Establish a Common Expiration Date with Other insurance Coverage.  A "housekeeping" reason and new policy must be rewritten with the same company for the same or higher" amounts of coverage.  This should be accompanied by a Cancellation form for the previous policy.  One year refund maximum.

4.  Duplicate NFIP Policies.  Refund is pro rata.  Insured can choose which policy to keep, but only one policy will be effective.  Document by submitting copy of declaration page(s) and copy of force-placement letter from the mortgagee if applicable. Force-placement usually has been done by the lender, but if both policies are applicable, the WYO company will cancel the force-placed policy.

5.  Non-Payment.  If there has been an "insufficient funds" check used to pay the premiums, policy is then nullified, with bank's notice attached to the form.  A full premium refund will be provided to the producer if the producer has sent his funds to the insurer.  If the WYO covers the premium for a prospective insured and then does not receive payment, the policy can be nullified.  Full refund.

And I not only have it but very soon I will have a master’s degree that will keep the young pups biting at my heels where they belong.

Insurance Continuing Education - IRS Penalties on Annuities

No matter what type of annuity you purchase, it is subject to a 10 percent IRS penalty for withdrawals of growth of income made prior to age 59 . No penalty is imposed on one's principal, i.e. the money put in by the owner is the owners money.

It makes no difference how old the annuitant (or owner) of the contract is, if they die then there is no penalty. Also, the Section 72 of the IRS Code states that the penalty is waived if the annuitant (or owner) is disabled. Generally, it must be the death or disability of the annuitant, not the contract owner or beneficiary, except where the contract is owner-driven, in which case all IRS penalties will be waived upon death or disability of the owner.

If the contract is annuitized, it will avoid penalty, but such annuitization must be elected by the contract owner within one year after investing in the annuity.

The age of the owner does not have to be 59 , indeed it is irrelevant.

The final way in which the 10 percent IRS penalty can be avoided is the contract owner being age 59 1/2 or older.

Because of these penalties, annuities are usually recommended for younger people unless it is part of a retirement plan such as an IRA or pension plan or profit-sharing plan. Of course, there is always the exception of the person who has sufficient funds so that they would not have to touch the funds in case of an emergency. Annuities are ideal candidates for the investor who is near or past age 591/2.

Unless the contract is owner-driven, the owner can be any age, from newborn to centenarian. But even with the penalty, it could still make good sense for a young person(s) but would depend upon how soon the money is withdrawn and the assumed rate of growth.

Inside an annuity, the contract-holders money will grow and compound tax-deferred, not tax-free. To say it another way, any and all income tax liability can be postponed indefinitely. The death of one spouse will not trigger income taxes provided that the beneficiary was the surviving spouse. What happens when the surviving spouse remarries? The survivor can name themselves as the beneficiary and can name a new partner as the annuitant. When the last spouse dies, the beneficiary(s) can postpone taxes for up to an additional five years.

Income taxes are always due in the year in which income or growth of the fund is received. The return of principal is never taxed, regardless of who receives the money. The amount of taxes on the growth will be based on the tax bracket of the person receiving the funds. Unfortunately the taxable portion is always considered as ordinary income, and does not qualify for capital gains treatment.

As is obvious, taxes will have to be paid at some time or other. This may be considered as a negative but perhaps it is not all bad. For instance, the owner of the annuity decides when withdrawals are to be made. Therefore, one would attempt to take out the money when they are at the lowest income tax bracket, i.e. their income is the lowest. Frequently this is when the person retires.
